Mack v. State Bar of California

In Mack v. State Bar of California (2001) 92 Cal.App.4th 957, an attorney who entered into an agreement with the State Bar to accept a private reproval in exchange for dismissal of disciplinary charges sued the State Bar for breach of contract after his petition for writ of mandate was summarily denied. The Court of Appeal affirmed the trial court's grant of judgment on the pleadings in favor of the State Bar on the breach of contract claim. The court reasoned the terms of the agreement expressly stated the disciplinary record was "a matter of public record" and could be disclosed upon public request. ( Id. at p. 962.)
