McChristian v. Popkin

McChristian v. Popkin (1946) 75 Cal.App.2d 249 was an appeal from a jury trial which resulted in a verdict in favor of the plaintiff for $10,000. In addressing the defendants' contention that the verdict was not supported by the evidence, the Court of Appeal stated: "'It is the province of the jury and then of the trial court upon motion for new trial, to determine and fix the amount of damages awarded a litigant.'" (Id. at p. 263.)
