McKelvey v. Boeing North American, Inc

In McKelvey v. Boeing North American, Inc. (1999) 74 Cal.App.4th 151, the plaintiffs likewise objected to the court judicially noticing documents submitted by the defendant to show the delayed discovery doctrine did not apply because plaintiffs were on notice of his government tort claim prior to expiration of the limitation period. The McKelvey court rejected the plaintiffs' hearsay objection to the documents on the grounds the truth of the facts contained in the documents was irrelevant. The documents were offered to show that, prior to expiration of the statute of limitations period, the plaintiffs had notice of or information of circumstances sufficient to put a reasonable person on inquiry.
