McManus v. CIBC World Markets Corp

In McManus v. CIBC World Markets Corp. (2003) 109 Cal.App.4th 76, the arbitration clause at issue provided, "'All disputes arising out of your employment or the termination of your employment . . . will be submitted to and resolved exclusively by a panel of arbitrators from the NASD Dispute Resolution, Inc. or the New York Stock Exchange.'" (Ibid.) The appellate court determined that "this language creates a mutual obligation to compel the employer to arbitrate any claims against the employee." (Ibid.)
