Mohilef v. Janovici

In Mohilef v. Janovici (1996) 51 Cal.App.4th 267, a municipality brought an administrative proceeding against the plaintiffs to abate a public nuisance. The plaintiffs challenged the administrative decision via petition for writ of mandate. They argued that due process entitled them to several procedural protections that they did not receive. The court agreed that the due process clause generally applied to the abatement proceeding. It then articulated the principle as follows: " 'Due process principles require reasonable notice and opportunity to be heard before governmental deprivation of a significant property interest.' " (Mohilef, supra, 51 Cal.App.4th at p. 286.)
