Morin v. ABA Recovery Service, Inc

In Morin v. ABA Recovery Service, Inc. (1987) 195 Cal. App. 3d 200, the jury rendered a general verdict in favor of plaintiffs that awarded a lump-sum amount of compensatory damages, which did not distinguish between personal injury damages and other damages. Plaintiffs then sought prejudgment interest available only for an award of personal injury damages. Notwithstanding the general verdict rendered in plaintiffs' favor, the court held that the plaintiffs carried the burden to show the jury's general verdict included a certain amount of personal injury damages eligible for an award of prejudgment interest.
