National Assn. of Wine Bottlers v. Paul

In National Assn. of Wine Bottlers v. Paul (1969) 268 Cal.App.2d 741, the trial court had declared void certain marketing orders and enjoined their enforcement. Subsequent to the filing of an appeal, the marketing orders on which the case was based were terminated. The appellate court held this action rendered the issue moot, but reversed the judgment for the purpose of remanding the case to the trial court with directions to the court to dismiss the action. This was done in order to avoid an implied affirmance of the lower court's order and injunction. ( Id., at p. 747.)
