Palo Alto Investment Company v. County of Placer

In Palo Alto Investment Company v. County of Placer (1969) 269 Cal. App. 2d 363, the Rubicon Road was going to be rerouted through a subdivision and the owners agreed to improve this new part, with the understanding that the old part would belong to them. After the improvements were made, a highway project was cancelled and Placer County argued it owned the old part. We held the old part was not needed, the owners had relied on the government, and public policy was not impaired by application of an estoppel to achieve abandonment. (Id. at pp. 367-369.)
