People v. Alkire

In People v. Alkire (1981) 122 Cal. App. 3d 119, the defendant pleaded guilty to a felony on the court's promise that any further confinement would not exceed two years. Defendant was placed on probation and served one year in county jail. When he was arrested after release and his probation revoked, he was sentenced to a three-year term. The Fourth District reversed the sentence, stating that "implicit in the judge's promise is a two-year limitation on any state prison time should it be imposed. The language would not alert anyone of a potential exposure to a longer term." ( Id. at pp. 124-125.)
