People v. Bejarano

In People v. Bejarano (1981) 114 Cal. App. 3d 693, the appellate court found several sentencing errors. The most significant was the trial court's failure to state reasons for imposing consecutive sentences. In response to the prosecution's argument that the reasons stated for imposing the aggravated term could be used as reasons for imposing consecutive sentences, the court found that such an interpretation would constitute a prohibited dual use of facts. (Id. at pp. 704-705.) The court held the trial court should have separately stated its reasons for imposing consecutive sentences.
