In People v. Caffott (1980) 105 Cal.App.3d 775, a summary of a telephone conversation was presented to a magistrate in support of an application for a search warrant. In fact, a tape recording of the conversation had been made. The court examined whether the summary intruded upon the role of the magistrate which includes drawing significant inferences from the underlying facts.
