People v. Calloway

In People v. Calloway (1974) 37 Cal. App. 3d 905, the court disapproved the practice of including in a probation report references to "police contacts" (detentions for questioning that did not lead to an arrest), without any effort to insure that the court could not mistake these records for actual convictions. (Id. at p. 908.) The court went on to hold, however, that even though the inclusion of this information was erroneous, the trial court did not rely on it and was not misled by the information.
