People v. Eades

In People v. Eades (1979) 95 Cal.App.3d 688, the trial court based an aggravation on the fact that a defendant, without warning or apparent motivation or provocation, shot the victim twice at point-blank range. Since the victim was unaware of the possession of the weapon and could not protect himself from the defendant's action, the appellate court found that the sudden and isolated manner of the killing were circumstances which demonstrated a particular vulnerability.
