People v. Han

In People v. Han (2000) 78 Cal.App.4th 797, the court concluded that, while the reference to "innocence" in CALJIC No. 2.01 "is inapt and potentially misleading" standing alone, it was harmless because "the other standard instructions make the law on the point clear enough, particularly CALJIC No. 2.90." Accordingly, the court found "no reversible error considering the instructions as a whole." ( Han, supra, at p. 809.)
