People v. Jochen

In People v. Jochen (1975) 46 Cal.App.3d 243, the officer was investigating a "tip" that defendant, a parolee, "had committed, or was involved in the commission of, a burglary." Defendant was stopped in his vehicle and the officer was able to observe, under the seat, a weapon which proved to be loaded. Although the police officers already knew defendant was the registered owner of the car, they opened the glove compartment under the pretext that they were looking for his registration. Stolen jewelry was found there. Other stolen property was found when the trunk was opened. In reversing the conviction, the court held that there was "neither probable cause or urgency to support the search of the glove compartment and no urgency to support the search of the trunk."
