People v. Moses

In People v. Moses (1996) 43 Cal.App.4th 462, the court held that the crime of contempt of court (Pen. Code, 166) is not a lesser included offense of child detention (id., 278.5) under the legal elements tests. ( People v. Moses, supra, 43 Cal.App.4th at pp. 467-469.) The child custody and visitation order at play in Moses awarded defendant a "'two week non-contiguous'" summer vacation with his children. The order did not specify the beginning and ending hours of defendant's summer vacation visitation right. ( Id. at p. 469.)
