People v. Municipal Court (Street )

In People v. Municipal Court (Street ) (1979) 89 Cal.App.3d 739, the Court found that defendants were entitled to discovery because they had made the sufficient prima facie showing of discriminatory enforcement based upon sex and place of crime (female prostitutes prosecuted for heterosexual acts in private apartments, but male prostitutes not prosecuted for comparable homosexual acts in public bathhouses). The Court found that "both of the classifications are arbitrary and unjustifiable and, if proved, would be sufficient to establish a denial of equal protection." ( Id. , at p. 749.)
