People v. Phong Bui

In People v. Phong Bui (2011) 192 Cal.App.4th 1002, the court concluded the defendant could not be punished for both attempted murder and mayhem because the three gunshots defendant fired within seconds of each other formed one transaction. (Id. at p. 1015.) Because "there was no evidence the defendant had independent objectives for the two crimes that would justify multiple punishment," the court held that the lesser mayhem sentence should have been stayed. (Ibid.)
