People v. Pokovich

In People v. Pokovich (2006) 39 Cal.4th 1240, the California Supreme Court held that statements made by a defendant in a competency examination cannot be used by the prosecution at trial. However, questions asked during a competency hearing relate to the crime or crimes with which appellant is currently charged. Statements made by an arrestee during booking in a case prior to the current offense are not analogous to statements made during a competency hearing, because the questions in a competency hearing focus on the current offense and the defendant's current mental capacity.
