People v. Reza

In People v. Reza (1984) 152 Cal. App. 3d 647, a noncapital case, the defendant wished to plead guilty to one charge in the information in the face of very strong evidence in order to avoid prejudice on a much weaker but more serious charge. The prosecutor opposed the plea, candidly stating that it wished to use the stronger charge to help prove the weaker. The court refused to accept the defendant's plea. On appeal, the court held that as long as the plea does not result in the exclusion of otherwise admissible evidence and the plea had a factual basis in the record, the court was obligated to accept the unconditional plea of guilt from a competent defendant.
