People v. Smithey

In People v. Smithey (1999) 20 Cal.4th 936, the murder victim had told a friend that someone had stolen a welder from the victim's property, and the victim believed it was the defendant. ( Id. at p. 971.) The trial court determined that the evidence was admissible for the nonhearsay purpose of showing the victim's state of mind concerning the defendant. ( Id. at p. 972.) The statement contradicted the defendant's claim that he had a friendly relationship with the victim and that she had invited him over on the day of the murder. (Ibid .)
