People v. Spearman

In People v. Spearman (1979) 25 Cal.3d 107, the court held that it was an abuse of discretion for the trial court to deny a motion to exclude a prior conviction for possession of heroin for sale in a prosecution for possession of heroin for sale and transporting heroin. The Spearman decision went a step further than Fries. It held the trial court erred in ruling the prior conviction admissible for impeachment because: "That prior conviction was identical to one of the offenses . . . It compels the conclusion that the trial court's ruling below was erroneous." ( Spearman, supra, at p. 116.)
