In People v. Stofle (1996) 45 Cal.App.4th 417, the appellate court remanded the case for reconsideration of whether to strike a "strike" because it had determined that defendant would be given five additional years for a serious felony. Reconsideration was required because defendant's sentence would be longer than the trial court had in mind. ( Id. at p. 422.)
