In People v. Trausch (1995) 36 Cal.App.4th 1239, the trial court reduced Trausch's conviction for second degree commercial burglary to a misdemeanor in part because the offense involving the theft of a cake from a bakery was motivated by necessity and Trausch acknowledged wrongdoing at a very early stage in the criminal proceedings.
