People v. Wein

In People v. Wein (1958) 50 Cal.2d 383, the defendant claimed a right to have a separate jury try the insanity issue on the ground that he would be prejudiced by voir dire examination on the dual pleas. The Supreme Court held that because it is in the discretion of the court to submit the issue of insanity to the same jury, there was no denial of due process or of a fair trial, concluding, the proper time for examination of the prospective jurors on the issue of insanity is during their selection at the beginning of the trial.
