People v. Wittig

In People v. Wittig (1984) 158 Cal.App.3d 124, the defendants were convicted of, inter alia, assault with a deadly weapon (id. at p. 126) and the People (in light of Adrian) conceded the trial court erroneously refused instructions that the defendants "were entitled to an acquittal if the evidence of self-defense was sufficient to raise a reasonable doubt." (Wittig, at p. 135.) However, Wittig concluded the error was harmless because the trial court gave CALJIC Nos. 2.90 and 2.01, and instructions on perfect self-defense. (Id. at pp. 135-136.)
