Pfeiffer v. City of La Mesa

In Pfeiffer v. City of La Mesa (1977) 69 Cal.App.3d 74, the court deemed it "fundamental that a landowner who accepts a building permit and complies with its conditions waives the right to assert the invalidity of the conditions." The court there also pointed out that the proper method for challenging the validity of permit conditions is by writ of mandate pursuant to Code of Civil Procedure section 1094.5, and that the recipient of a permit could not "convert" the right to institute such proceedings into a cause of action for other relief (in that case, a cause of action for inverse condemnation).
