Quintana v. Guijosa

In Quintana v. Guijosa (2003) 107 Cal.App.4th 1077, despite proof of past abuse, the trial court denied the request for a temporary restraining order and denied an application for a domestic violence restraining order without a hearing, solely because the applicant was living in the United States while her children were "abandoned in Mexico" and all the applicant had to do to be free of the respondent's violence was to return to Mexico.
