Rosefield Packing Co. v. Superior Court

In Rosefield Packing Co. v. Superior Court (1935) 4 Cal.2d 120, the court stated: "If the statute operates immediately to cut off the existing remedy, or within so short a time as to give the party no reasonable opportunity to exercise his remedy, then the retroactive application of it is unconstitutional as to such party. " The court continued by stating that what was a reasonable time was "not a matter committed to the discretion of the trial court. The question is one of constitutionality of the statute and that the trial court cannot consider individual hardship or other circumstances, but must give effect to the express provisions of the law." ( Id., at p. 124.)
