Roth v. Rhodes

In Roth v. Rhodes (1994) 25 Cal.App.4th 530, the party seeking a continuance submitted a declaration indicating that two depositions remained to be completed, and that the expert opinions had not yet been received. The court held this was inadequate: "There is no statement which suggests what facts might exist to support the oppositions to the motions. The trial court was fully justified in finding the declaration insufficient to support a continuance." (Ibid.)
