San Francisco Police Officers' Assn. v. Superior Court

In San Francisco Police Officers' Assn. v. Superior Court (1988) 202 Cal. App. 3d 183, the San Francisco Police Officers' Association challenged a rule permitting the individual who complained about a police officer's conduct to be present at the confidential investigation hearing and to have access to the decision and materials. (Id. at pp. 186-188.) In rejecting this challenge, the court emphasized that the investigation hearings conducted by the San Francisco commission are considered part of the factfinding process, and any records that are part of the peace officer's personnel file, or become part of the personnel file, are considered confidential and the complainant would not have access to these materials. (Id. at pp. 188-192.)
