Sapin v. Security First National Bank

In Sapin v. Security First National Bank (1966) 243 Cal. App. 2d 201, the note contained a specific place in which to indicate a date for repayment. The parties left the space blank. After the original payee died, the party owing under the note sought to enjoin demands for payment, arguing that the deceased original payee had agreed to forbear until real property securing the note was sold. Sapin held, correctly, that this parol evidence would contradict the note's explicit omission of a due date and was therefore barred. ( Sapin, supra, 243 Cal. App. 2d at pp. 203-205.)
