Spitzer v. The Good Guys, Inc

In Spitzer v. The Good Guys, Inc. (2000) 80 Cal.App.4th 1376, the plaintiff indisputably had told her employer about her disability and about her need for accommodation. (Spitzer, supra, at p. 1380.) The question before the Spitzer court was whether a triable issue of fact existed as to whether the plaintiff had failed to provide her employer with notice "that reassignment was necessary to reasonably accommodate her limitations." (Id. at p. 1385.) The record contained evidence that the plaintiff's supervisor was aware that "the restructuring of plaintiff's position did not succeed in enabling her to perform her job properly." (Id. at p. 1387.) Since the extent of the employer's knowledge that restructuring the plaintiff's job had failed to reasonably accommodate her disability was unclear, the court concluded that summary judgment in the employer's favor was improper.
