Stone v. Regents

In Stone v. Regents (1999) 77 Cal.App.4th 736, the court upheld the employer's denial of a defense on the ground that stealing ova from one woman in order to implant them in other women fell outside the physician's scope of employment. The court took pains to note it was not deciding the issue as a matter of law. Rather, it simply concluded that substantial evidence supported the agency's finding that the physician acted outside the course and scope of employment. ( Id. at pp. 746, 748.)
