Stop Youth Addiction, Inc. v. Lucky Stores, Inc

In Stop Youth Addiction, Inc. v. Lucky Stores, Inc. (1998) 17 Cal.4th 553, the court found that a private corporation could maintain an action against the defendant grocery store under the unfair competition law on behalf of the general public to prevent the store from selling cigarettes to minors in violation of Penal Code section 308. (Stop Youth Addiction, Inc., at pp. 558, 572.) That Penal Code section 308 and the STAKE Act did not contain an express private right of enforcement did not mean that suit under the unfair competition law was preempted or impliedly repealed.
