Sunbeam Construction Co. v. Fisci

In Sunbeam Construction Co. v. Fisci (1969) 2 Cal. App. 3d 181, the plaintiffs sued the contractor and roofing subcontractor who built their apartment buildings for damages caused when the roofs leaked. The roofs had been constructed in accordance with the plaintiffs' respective plans and specifications that did not provide for adequate drainage for the roofs. (Id. at p. 183.) The Sunbeam court affirmed summary judgment for the defendants on the ground there was no implied warranty requiring defendants to supplement the plaintiffs' plans to provide for drainage. (Id. at pp. 186-187.)
