Sutton v. Golden Gate Bridge, Highway & Transportation Dist

In Sutton v. Golden Gate Bridge, Highway & Transportation Dist. (1998) 68 Cal.App.4th 1149, there was substantial evidence that there was a design decision not to install a moveable median barrier as part of a project to replace a deteriorating deck of the Golden Gate Bridge. (Ibid.) The opposing expert opined that the project was relevant to maintenance of the bridge, not the design of the bridge. (Ibid.) He did not call into question whether a decision was made. (Ibid.) The opposing expert's disagreement as how to characterize the decision was not sufficient to create a triable issue. (Ibid.)
