Swan v. Talbot

In Swan v. Talbot (1907) 152 Cal. 142, a person by reason of his own drunkenness was induced to sell $ 12,000 in property for $ 2,000 "paid to him while in the midst of a drunken debauch." ( Id. at p. 145.) The court in Swan upheld the trial court's monetary award in lieu of a return of the property, because the property's return was impracticable for some unstated reason.
