Whitehouse v. Six Corp

In Whitehouse v. Six Corp. (1995) 40 Cal.App.4th 527, a creditor asserted that a third party claimant's ownership of property was based on a fraudulent transfer. The court held that the rule that a party claiming fraud has the burden of proving a fraudulent transfer applies in a third party claim proceeding. (Whitehouse, at pp. 533-534.)
