Wood v. Jamison

In Wood v. Jamison (2008) 167 Cal.App.4th 156, an attorney represented an elderly client and a third party posing as the elderly client's nephew in a series of transactions that enriched the third party at the expense of the elderly client. (Id. at pp. 158-159.) Following a trial, a judgment was entered against the attorney that included a fee award under section 15675.5. (Id. at pp. 164-165.) On appeal, the attorney contended that the fee award was improper because there was no evidence that he had "knowingly assisted" the third party's financial abuse. (Ibid.) In affirming the judgment, the appellate court concluded there was sufficient evidence that the attorney knew that the third party was taking the elder's funds for an improper purpose. (Ibid.)
