Young v. Bank of America

In Young v. Bank of America (1983) 141 Cal. App. 3d 108, the plaintiff experienced a negative credit rating because of incomplete information given by defendant to TRW, and the rating caused another bank to reject her credit card application, caused her difficulty cashing checks and embarrassment at the prospect of going shopping, as well as "feelings of helplessness and frustration because the defendant refused to adjust her account and repeatedly demanded payment." Additionally, she experienced severe stress, nervousness, headaches, insomnia and interference with her job performance. ( Id. at p. 115.) The reviewing court found this to be "ample evidence" of substantial emotional distress. (Ibid.)
