In Mines v. State, 390 So. 2d 332 (Fla. 1980), the Court determined that the trial court abused its discretion in sentencing the defendant to death when it refused to even consider the statutory mitigating factors concerning the defendant's mental condition simply because the expert testimony established that the defendant was legally sane.
