Extent of Jury's Discretion In Decisions on Parole on Life Sentences

In Gore v. State, 706 So. 2d 1328 (Fla. 1997) the Supreme Court of Florida approved the trial court's decision to instruct the jury to rely on their recollection of the evidence presented in response to a jury question asking "if and when parole could occur on these other life sentences." Id. at 1333. However, the Court in Gore did not indicate whether answering the jury's question would have been an abuse of discretion, which is essentially the issue presented in the instant action.
