Boggs v. State

In Boggs v. State, 194 Ga. App. 264 (390 S.E.2d 423) (1990) the defendant consented not only to the initial search of the car by the officer but also to a subsequent search by a drug dog. Thus, in Boggs, unlike the drug dog search and the detention therefore were consensual. The Court note that Boggs did not raise the issue of the propriety of a police officer detaining a defendant to seek permission to search his vehicle after the investigation for which the stop was made has been concluded. Therefore, this issue and its factual variants were not addressed in that case.
