First Nat. Bank &c. v. Childress-Ross Properties

In First Nat. Bank &c. v. Childress-Ross Properties 182 Ga. App. 112 (354 SE2d 694) (1987), the Court affirmed a trial court's denial of an application for confirmation because the expert testimony supported the trial court's finding that the foreclosure bid was not true market value. See Childress-Ross, 189 Ga. App. at 766-767. That case involved 12 condominium units, which were handled by 17 different security instruments. See id. at 765-766. The expert testified that the true market value of each of the lots totaled more than the foreclosure sale if sold separately, but the value would be lower if they were sold to a single buyer. See id at 766.
