Lingerfelt v. State

In Lingerfelt v. State, 235 Ga. 139, 140 (218 SE2d 752) (1975) the Supreme Court of Georgia held that the defendant's Sixth Amendment right to confrontation was violated when the prosecutor asked questions of a witness that were premised on a transcript of testimony that the witness had given at a prior commitment hearing and the witness chose to remain silent. Id. at 139-140. The Court commented that the prosecutor could not be allowed to do indirectly what could not be done directly. Id. at 140.
