Mitchell v. State

In Mitchell v. State, 268 Ga. 592 (492 SE2d 204) (1997), the Supreme Court of Georgia reversed a cocaine trafficking conviction of the passenger of a vehicle in which cocaine was found under the passenger-side floor mat. See 268 Ga. at 592-593 The Court determined that the jury's verdict was not reasonable because it was based on mere spatial proximity to hidden contraband, and the defendant in that case did not own or control the vehicle in question. See id. at 593.
