Moody v. Martin Motor Co

In Moody v. Martin Motor Co. 76 Ga. App. 456 (46 SE2d 197) (1948), the Court reversed the trial court's decision to sustain the demurrers filed by the defendant repair company in a personal injury action filed by the plaintiff who was injured as a result of the defendants' alleged negligent repair of a truck. Id. In Moody, the defendant's breach of its duty to make repairs in a nonnegligent manner served as the basis for the plaintiff's claim for negligent performance of a contract.
