Ponce de Leon Condo. v. DiGirolamo

In Ponce de Leon Condo. v. DiGirolamo, 238 Ga. 188 (232 S.E.2d 62) (1977) our Supreme Court found that a judgment for punitive damages was supported by the evidence where the defendants had developed property adjacent to the plaintiff's residence. Despite the plaintiff's warnings about the danger of increased water discharge, the defendants graded and paved their property and routed a drainage system onto the plaintiff's property, causing water damage. The defendants never altered the drainage system despite the plaintiff's protests before and after its construction.
