In Riverdale Pools & Constr. v. Evans, 210 Ga. App. 127 (435 S.E.2d 501) (1993) the trial court granted partial summary judgment against the defendant on the issue of liability, leaving unresolved the amount of damages. The parties later settled the case and entered into a consent judgment for a specified sum. Thereafter, the defendant filed an appeal, challenging the trial court's ruling on liability. The Court held that a party not aggrieved by the judgment of the trial court is without legal right to except thereto, since he has no just cause of complaint.
